 REVOLUTIONARY WAR SERVICE

Fought for the American side during the Rev War and was paid for services performed in 1782.

Excerpt from a book Historical Southern Families volIII : page235-.236

"James Gibbs appears to have served during the Rev War on the opposing side to his brother Col Zachariah Gibbs, A letter is quoted from Mr. A. S. Salley, then Secretary of the South Carolina Historical Commission, dated July 14, 1938, to Miss Fannie Lee Sparks, of Union SC, "We have a record of pay issued to James Gibbs for ten days militia duty in 1782. We have an Account which he rendered against the state for militia duty in 1778, 1779, 1780, for a total of 481 days. He did not furnish proof other than an affidavit before David Hopkins, Justice of the Peace, which he did not sign; consequently, the bill was never paid. He evidently was not a TORY."

Pp. 200-202: Philemon Waters and James Gibbs of Pinckney Ville District, bound to Thomas Hays of same, in the penal sum of L100 sterling, to be paid to Thomas Hays, 30 June 1792, to make titles of tract of 151 acres, on the branch of the Fairforest called Mitchells creek, formerly property of Daniel Plumer whose estate was confiscated and sold... P Waters (Seal), James Gibbs (Seal), Wit: Richd Hays, John Cain. Proved by Richard Hays before Thos Blassingame, J. P., 11 June 1796. Recorded 17 Jun 1796.

"F. 254-257: 5 Oct 1795, William Bratton, sheriff of Pinckney District, to Ann Gibbs of Union county, whereas James Gibbs deceased was seized of a tract of land and said James Gibbs was indebted to James Harrison, who did exhibit his petition to the Judges of the Court of Common Pleas for Pinckney District upon hearing a process was issued from said court, at November Term 1794 and adjudged to said James Harrison l12 s4 d 1 1/4, by writ of fi fa, sold 5 Oct 1795 and sold to Abraham Nott for L50 but order of said Abraham Nott Esq'r I make title to Anne Gibbs, subject and liable to all mortgages, prior executions, etc. Wm Bratton S. P. D. (Seal). Wit: Solomon Spann, Thos Hayes. Proved in Union county by oath of Solomon Spann 9 Nov 1799 before And'w Torrance, J. U. C. Recorded 16 Nov 1799.

"Memorial exhibited by James Gibbs..... 640 acres of land granted to the said Gibbs by the Governor of North Carolina, 15th May 1772, which land by a boundary line run between this Province of North Carolina now falls within the limits of the Province of South Carolina. Situated on west side of Fair Forest, beginning at a red ork on Zachary Gibbs line; thence south 65 and east 140 poles to a Stake; thence south 65, west 334 poles to a Stake; thence north 25 & west 310 poles to a stake on Zachary Gibbs' line; thence with his line N. 80, e. 162 poles to a chestnut, his corner; thence with his other line to the beginning. Survey certified 11th August 1774; granted 0th September 1774. Quit rent 3/ Sterling; 4/ Proclamation money, per 100 acres. In witness where of he hath hereunto set his hand the 17th march 1775.

Will of James Gibbs... my land I live on to be divided among my three youngest boys, Hiram to have the plantation; Agatha my daughter have one shilling sterling; my land in Spartan be sold if I have not moveable property enough to pay my debts; Mr Jesse Connal and my son Zachariahs to have the management of my estate with my wife until my three young sons come of age; I desire to be buried in my own garden; the Negroes to be kept on the place and not sold until my small children is raised; I desire my children to have an equal part of my property but Agatha; my son Zacharias to have my cool spring land in Spartanburgh; my son John should have my negroe Joe after the death of my wife and Hiram comes of age; to my daughter Susannah, a young negroe if Juno ever have one and if more that one the nexxt to be for my son Zacharias; my son Zacharias to make titles to all the land I have sold in Georgia or else where agreeable to my bonds for that purpose; 8 Aug 1793.
