Lincoln

October term, 1832
On this 17th day of October, 1832, personally appeared
before the Justices of the County Court of Lincoln County, Tennessee,
William White, a resident of said county and state, aged about 78 years
the 10th of January next, who being duly sworn according to
law, doth on his oath, make the following declaration in order to attain
the benefit of a provision made by act of Congress passed June 7, 1832.
That he entered the service of the United States under the following
officers and served as herein stated, viz.: That he volunteered in
Colonel Stephen’s Regiment of Minutemen in Fauquier County, Virginia
some time in the month of September in the year 1775 [as he
thinks], Major Thomas Marshall also commanded in said regiment. The
company to which I belonged was commanded by Captain John Shelton who
was afterwards killed at the Battle of Brandywine or Germantown [ I now
forget which] and also by Lieutenant John Marshall, son of Major Thos.
Marshall, and now Chief Justice of the United States. In the same month
we marched from our county to Culpepper Courthouse in Virginia, where we
commenced building barracks, but before we completed them an express
arrived for us to go to the lower country where Gov. Dunmore was raising
a disturbance. We immediately marched to Williamsburg, and were there
stationed in the Capitol three or four weeks during the time our
regiment was stationed at Williamsburg. I volunteered and went with a
rifle company commanded by a Capt. Bluford to Hampton Road and at
Hampton we had an action with five small British vessels called
“tenders” lying in a creek a small distance away from the bay, one
of which we took and drove the others off. From Hampton we marched back
to Williamsburg and I joined my regiment. We then started towards
Norfolk, where Gov. Dunmore had established himself, and came to a
bridge about 14 or 15 miles from Norfolk, called at that time “ the
long bridge” at which place was a British fort about 5 miles below the
bridge at a ferry which was guarded by some Tories and Negroes. Gen’l.
Scott, being with our army at his time, beat up for volunteers to storm
the lower fort, and I and several of my company besides others went and
stormed the forts dung the night. We completely routed them and took
several Negroes and one white man prisoner. We marched back to the long
bridge and raised breastworks against the fort where Fordyce commanded.
In 3 or 4 days afterwards, Fordyce marched out of the fort to storm our
breastworks, and we killed, wounded and took prisoner his whole company
except one Ensign who made his escape. Capt. Fordyce was shot through
the body with ten balls. We then marched to Norfolk against Dunmore who
retreated to his vessels and set fire to the town. We lay at Norfolk a
few weeks and were then marched back home where we were discharged about
the middle of April, having been in service between 7 and 8 months. In
the middle of May following, I went to Alexandria, now in the District
of Columbia, to see my brother, John White, who had enlisted in a
company commanded by the same Capt’ Shelton, and who was so unwell as
to be unable to do service. I then became a substitute for my brother
for three months, after which he returned and took his place. During the
time I was a substitute, we lay the greater part of that time at
Alexandria, but 3 or 4 weeks before I left that service, we marched over
to the Washington side of the Potomac River, and after remaining there 2
or 3 weeks, we started towards Philadelphia, but before we had gone far,
my brother came and I returned home.
Sometime
in the latter part of 1780, I enlisted in the service of the United
States for the term of 18 months, in the company commanded by Capt.
Warman [ or some such name] attached to the regiment of regulars
commanded by Colonel Gaskins and Major John Willis, in Fauquier County,
Virginia.
We
assembled at Fredericksburg, where, as soon as the different companies
arrived, they were sent to Powhatan Courthouse to be disciplined by
Gen’l. Steuben. As soon as I arrived at Fredericksburg, I was
appointed Orderly Sergeant in which capacity I continued to act during
the time I was in service. Part of the company to which I belonged,
under Capt. Field, and the other under a Lieu’t. whose
name I now forget, were on our way to Powhatan Courthouse for the
purpose before stated. When we had proceeded some distance, an express
arrived, informing us that the British had burnt Manchester, and us to
cut across the country to
Point of Forks in order to avoid them as we had not yet received any
arms, and to guard that place as our arms and public stores were there.
Here
we joined Gen’l. Steuben and drew our arms. We remained there 3 or 3
days when an express arrived that they British, under Col. Tarleton were
marching upon us. Steuben became alarmed and ordered us cross over James
River and remove our stores, but before we had entirely succeeded,
Tarleton came up and took some of the stores, 2 of the baggage wagons,
and made prisoners of the guard. On that night Steuben ordered a large
quantity of rails to be produced to made fires and ordered the army to
retreat leaving one Ensign and a small company to keep up the fires in
order to deceive the British.
He
had sent up and down the river 4 or 5 miles to destroy all the boats to
prevent the enemy from crossing to pursue us. We retreated to Halifax
Old Town, marching 3 days and nights without provision and without rest.
We stayed there a few days and nights and were ordered to return to
James River and join Gen’l. Wayne and Lafayette who were then pursuing
Lord Cornwallis. We crossed the River at Carter’s Ferry and joined
Gen’l Wayne at headquarters and our regiment was attached to his
forces as light infantry. Cornwallis and his army retreated down the
river and our army under Gen’l Wayne continued to maneuver so as to
harass them very much in their march, especially at Green Springs where
they crossed the river, we attacked their rear and did them considerable
injury. After crossing the river, which was near Old Jamestown, they
marched to Williamsburg and proceeded to Yorktown, and all which route
we followed them and finally besieged and took them all prisoner at that
place. After
the surrender of Lord Cornwallis, our regiment was marched back to
Powhatan Courthouse where we remained until the latter part of the
succeeding April, our regiment being then ordered to Savannah and I
being very unwell, I procured a substitute to go in my place and I
returned home, and was not in service any more during the war. I had a
written discharge, but it is now lost. I think the term of my service
was from the time I enlisted until the time I left the service was about
14 or 15 months, during all which time I acted as Orderly Sergeant in
our regiment. In addition to the officers before mentioned, I was
acquainted with Gen’l Washington, Col Hamilton, his aid,[ who
commanded us at the time we were drawing in the entrenchments at the
siege of Yorktown] also with Gen’ls Wayne, Green, Lee, Scott, Woodford,
Sumpter, Morgan and others.
I was born in Fauquier County, Virginia on the 10th
day of January, 1755. I have a record of my age now in my possession. I
lived there when I entered service. After the Revolutionary War, I moved
to Rowan County , North Carolina, where I lived about 30 years, then
came to this county where I now live. At the time I left the service, a
new Colonel had just been appointed to the command of our regiment from
whom I secured my discharge, but whose name I now forget. I hereby
relinquish every claim whatever to a pension or annuity except the
present and declare that my name is not on the pension roll of any

Lists for 1802-15, has William White in Capt. Douthit’s Co. with 78
acres of land from 1811-1818 which is presumed to be the year of his
migration to Lincoln Co TN [ he had son born in NC 1818 and next and
last child born in Lincoln Co TN in 1820 and he appears on the census in
1820 in Lincoln Co TN.
There
is a deed in Rowan Co NC dated 27 December 1818, in which William White
conveys to James Tomlinson 78 acres of land of Cedar Creek, adjoining
Asa Cox on the southeast side of the Georgia Road. This deed is
witnessed by John Pierce and Nancy Brown, proven by oath of Pierce in
court Feb. 1823 and recorded in DB 27, page 531.
In
a Narrative History of Rowan Co. NC, James S. Brawley, writing in 1953
says;
At
the time Granville’s survey was run [1746] people were beginning to
fill the valley between the Yadkin and Catawba Rivers. The first
settlers seemed to have followed the PeeDee and Santee, and picked up
lands in the southern park of what is now Rowan Co. Others poured in
from PA and traveled the Great Wagon Road that led them through the
Shenandoah Valley into the north Carolina Piedmont, another route
followed the Upper PA Road
which is found on the map of 1775, and shows that route, instead of
turning eastward in Virginia towards
Amelia Court House, continued through the
Shenandoah Valley to Winchester, Salem, and into NC where it
stopped just about 10 miles above Reedy Creek, a distance of about 435
miles.

The True Story of

Christmas Eve, 1864, Giles Co TN.
As sent to me by my cousin, Lloyd Nolan Jackson, a descendant of
William Clark White
William ‘Clark’ White married Eliza K. Wilkerson
Son, James Monroe (Bud) White married Amanda Tennessee Warren
Dau., Lota Ethel White married Edward Elmore Neely Sr.
Dau., Mable Etha Neely married Nell Jackson
Son, Lloyd Nolan Jackson married Kathryn Jean. Grissom .They live
at Muscle Shoals, AL in 2002. Lloyd hired a genealogist in Washington,
D.C. who located the voluminous file in that city about the murder of
Clark White. I have extracted the important sections for this story
printed here. It is interesting how the two newspaper stories in Giles
Co. and family traditions differ from the actual event.

War Department, Bureau of Military Justice, January 29, 1867
To the President.
William F. Heron/Herrin was convicted of murder by a military
commission at Pulaski, Tennessee, in July 1865, and sentenced to be
hanged. This sentence was approved and confirmed by Maj. Gen. Thomas,
and ordered to be executed but was commuted by the Executive, to
imprisonment for life. He is now confined in the penitentiary at
Nashville, Tenn.
Hon. Ed. Cooper presents a petition for the full pardon of the
accused, signed by thirty two citizens of Tennessee, with letters from
prominent citizens in aid thereof. Mr. Cooper states that he knows
nothing of the facts in the case, but is satisfied from the earnest
appeals made in his behalf by the worthy, and loyal men who sign his
petition, that it is one fit for clemency.
The petition sets forth that the accused is the infant son of an
esteemed citizen and that when he committed the murder for which he is
undergoing punishment, he was but fifteen years old, that he was of a
very tractable disposition, and was in company with some very corrupt
men, one of whom was an officer, and all neighbors who had an old
grudge against the deceased; that they gave young Herrin drink, and
then incited him to the commission of the act. It is set forth that
the officer who commanded the squad has left the county, or wanders
unknown in consequence of the deed. It is stated that the accused was
mild, gentle, and generous towards Federal officers in Southern
prisons.
The record of his trial has been carefully examined, and shows
that, if he was as young in years at the time of the commission of the
murder, as is alleged, he has fully matured in criminal capacity, as
the act was surrounded by circumstances of peculiar atrocity.
It appears that the accused was one of a band of desperadoes, who,
on the 24th of Dec. 1864 visited the house of the deceased,
Clark White, who was a loyal citizen of Giles County, Tenn., for the
purpose of robbing him of his stock. The story of the murder and its
attendant circumstances, is thus narrated by the wife of the victim.
" I heard a gun fired and went to the door and saw the parties
mentioned coming up toward the house. They stopped and drank whiskey
in the lane, and rode up to the gate where they drank whiskey again.
They all rode up to our stable except two; Jim Tucker and another man
staid at the gate. They rode around the stable hunting for stock, and
called a darkey to them, and tried to make him tell them where my boys
and the horses were, - and my husband. They cursed, and jabbed their
pistols against his breast, and into his face, and swore they would
shoot him if he did not tell him where they were. Geo. David, Buck
Pugh, and Tom Greyson were the most active around the Negro. My
husband started to go out of the house, and I begged him not to go
out. The Negro told them when asked by George David "where the D—d
old Tory was", that he was in the house. Bill Skelton said, let
us go and fetch the old Tory out and kill him.
Geo. David said let us ask the nigger a few more questions and make
him tell us where the boys and horses are. I told my husband I would
go out and talk with them. He said I must not as they would frighten
and perhaps harm me- he said he would go out if they killed him as he
would not be trampled upon in any such way. I started our and went
into the yard and I heard Jenk Walls order the nigger to throw down
the fence, and told the accused to go and kill the D—d old Tory.
Accused charged up towards the house on horseback- my husband was
following right behind me and met the accused about ten steps from the
door. The accused had a revolver cocked in his hand and as he charged
up my husband said " come Gentlemen, do not scare my wife".
The accused leveled his revolver upon him and said as he shot him
(G-d D--n you, you have good horses". I was within two steps
of my husband when he was shot. After the accused had shot my husband,
he charged around the yard and cursed and swore and acted as if he had
intended to kill all of us. He did not get off his horse at all. He
staid at least an hour-as soon as my husband was shot, he fell forward
upon his face, and died immediately. The ball entered near the right
shoulder in front and came out on the left above the hip. I implored
them to help me get him into the house. I begged them on my knees and
they would not do it.
I sent my oldest girl after the neighbors. The accused chased after
her with his pistol cocked and swore he would shoot her if she
attempted to go, that no-body should come. I sent another girl in
another direction for the next nearest neighbors, and the accused
chased her some 200 yards and I got Jim Tucker to run through the
field and turn him back. He brought him back and the girl went on. I
think about half an hour after my husband was shot, four of them
helped me take him into the house. The four were; Buck Pugh, Tom
Greyson, John Tucker and Jim Tucker. My husband was an uncle to the
Tucker boys. I asked Jim Tucker who the man was that killed my
husband. He refused to tell at first, but finally said his name was
Heron. I looked at him long and well that I might know him if I ever
saw him again. The accused is the man who killed my husband. The party
rode off laughing and seemed in fine spirits over the deed. I was
pregnant at the time and was confined within forty- eight hours
afterward.
The testimony of Mrs. White is fully corroborated. Indeed, the
prisoner, by his counsel, admitted that he killed the deceased, and
pleaded the absence of malice. In view of such a record which so
clearly discloses the brutal nature of the accused, exhibited, in the
case under consideration, by the murder of an unarmed man, whose
loyalty to his country furnished sufficient justification in the eyes
of the murderer- it is recommended that there be no interference with
his sentence as mitigated.
It may be remarked that owing to the disturbed state of affairs at
the time of his trial, there were no civil courts in the section of
the country where the military commission sat, as appears by the terms
of the order convening it.

R24.259 Judge Advocate General
September 23, 1902 (mailed Sept. 24, 1902)
Madam;
Acknowledging receipt, by reference from the White House, of your
letter addressed to the President (Theodore Roosevelt), under date of
June 26th last, urging, for reasons stated, a pardon for
William F. Herron, who was convicted of murder by a military
commission, at Pulaski, Tennessee, July, 1865, and was sentenced to be
hanged- which sentence was commuted by the President to imprisonment
for life, the prisoner subsequently escaping and remaining at large, I
beg to inform you that if view of the long time which has elapsed, and
the desire on the part of all good citizens to forget the horrors of
the period when this offense was committed, the recommendation of the
Judge-Advocate General of the Army that the unexecuted part of Herron’s
sentence be remitted but that a full pardon be not granted , has this
day been approved.
Very Respectfully,
William Cary Lenger
Acting Secretary of War
Mrs. John A. Jackson
P. O. Box 188
Pulaski, Tennessee
Pulaski, Tenn October 8, 1902
Mr. Wm. Cary Langer;
Acting Sec. Of War
My Dear Sir;
I am made happy and grateful this morning by your letter bearing
the glad tidings for William F. Herron !
Thank the Judge Advocate for me a thousand times for his decision.
Gratefully Yours,
Mrs. John A. Jackson
Please note that William Frank Herron was actually 17 years old [
not 15] at the time he murdered William Clark White as the Washington
D. C. papers go on to state. Wm. F. Herron hired Lolon/Colin? E. Rose,
Esquire, as his attorney at the Pulaski Court case.
James (Bud) Monroe White and his sister, Charlotte, were both
witnesses for their father against Mr. Wm. F. Herron and both saw
their father murdered. Bud said he had seen Wm. F. Herron the previous
Sept. in town but did not know him. He said the Herron family lived
about 30 miles away in Lawrence Co TN. He said all the other men were
neighbors of the White family in Giles County and known.
Andrew J. Pickett, and 7 or 8 others were lying in the woods about
300 feet from the murder scene and saw it happen. They scrambled away
to safety. Andrew testified at the trial. He said Jack Wallz? and Bill
Skelton were part of the murderous thieves. The name Jenk Walls is
also mentioned and appears to be the same as Jack Wallz?
Submitted by a great, great granddaughter of William Clark White.
