Petition of P.B. Cordell. In the matter of the Estate of Joseph Osborn
deceased, for Letters of Administration.

To the Hon. J.B. Nickel Judge of the County Court of McDonough County,
in the State of Illinois.

   The Petition of the undersigned, P.B. Cordell respectively represents
--- Joseph Osborn late of the County of McDonough aforesaid, departed
this life at his residence in said County, on or about the first day of
November A.D. 1870, leaving no last will and testament as far as your
petitioner knows or believes.

  And this Petition further shows that the said Joseph Osborn died, seized
and possessed of Real and Personal Estate, consisting chiefly of farming
and timber lands, Horses, Cattle, Hogs, farming utensils, Household and
Kitchen furniture, etc. Said Real Estate estimated to be worth about two
thousand dollars. All of said personal estate being estimated to be worth
about five hundred dollars. That said deceased left surviving him

his widow, and Solomon Osborn, Andrew J. Osborn, Sebrina
Mayfield
, John Osborn, Lydia Osborn's heirs and Stephen J. Osborn's 
heirs his
children as heirs. That your petitioner being requested by the widow 
and heirs of said deceased, and believing that the said estate should be immediately
administered, as well for the proper management of said Estate as for the prompt
collection of the assets, by virtue of their right under the Statue he therefore pray 
that your honor will grant Letters of Administration to him the said P.B. Cordell in
the promises, upon his taking the oath prescribed by the Statue, and entering into
bond to such sum, and with securities, as may be approved by your honor.

THE HISTORY OF McDONOUGH COUNTY ILLINOIS

     Although he is shown living in Schuyler on the 1830 Census, it is thought Joseph Osborn actually lived in McDonough County. He is on the 1831 tax list there. Born in North Carolina about 1788, it has not been determined who his parents were. He lived near Solomon Osborn, who married Mary Stewart, in Barren Co., KY, Crawford Co., Indiana; he also lived in Vermilion County, IL where Solomon died in 1828. The Draper Papers contain the record that Solomon had eight sons and three daughters, three of the oldest sons have not been identified. All of Joseph's children were born in KY and IN prior to his move to Illinois. He came to McDonough Co. about 1829 and lived in the Industry Area. He was Justice of Peace, beginning in 1832, and performed several marriages. Nancy was the name of his wife, but her maiden name is unknown; it has been speculated that it was Jones because they named their third son Stephen Jones, they were probably married in KY. Joseph died in 1870 and is buried in the Peak Cemetery, which is 100 yards west of the Wihlem Cemetery near Industry. When or where his wife died has not been determined.

     Solomon was the name of Joseph's Oldest son; he was married and did not move to McDonough Co. at the time his father did but came later, where he died in 1877. He had 15 children by his first wife, Dicy Smith, and seven by his second wife, Elsa [Smith] Johnson. They were Joseph, William, Elizabeth, Lydia, Isaac, Nancy, Mary, Francis Marion, Elijah, Louisa, M. Jane, aurena, Dicy Ann, Lucinda, Alfria, Ada, Almeda, Lorina, Alice, John, Noah W., and Henry C.

     Lydia, Joseph's oldest daughter, was born about 1809 in KY. She married her cousin Ephraim Osborn, in Vermilion Co. He was the son of John Osborn and Sarah Stewart. They moved to McDonough Co. about 1830 and to Putnam Co., MO in late 1840 where she died in 1849. Their children were Mary, Eliza, Joseph, Andrew J., John, Elijah and Daniel Boone Osborn.

     John married Francis Hackworth in Vermilion Co., in Jan 1830; they were living in McDonough Co., in 1850, in Putnam Co., MO in 1860, and back to McDonough Co. in 1870. Their children were Susannah, Sarah, Andrew J., Daniel, Hyram, James, Martha, Robert, Isaac, and John.

     Stephen Jones Osborn was born about 1812 and married Julian Simpson in McDonough Co. in 1852. Their children was Jasper and Lydia; he died before his father's will was probated in 1870.

     Sebrina Osborn married John Mayfield in McDonough Co. in 1837. [see story in this book on the Mayfield family].

     Andrew Jackson Osborn was born about 1820 and he married Elizabeth Cockerham in McDonough Co. in 1841. They lived in McDonough Co. until after 1860 and when they moved to northern Missouri where so many of the Osborns had gone. Their children were Louise, Abner, Rachel. Stephen, and Finis.

     Mr. Mayfield, in the 'History of McDonough County', mentions the 
Service of Joseph Osborn in the War of 1812.  In the Kentucky records
Index of their Vets from this conflict is mentioned only one Joseph. I list
that record below, I have ordered this record.  In addition, and for
the record I list other Osborn's and Pennington's, as they may be related.

McDonough County - Part of the Military Tract

McDonough County, Illinois is in the center of the Military Tract, land set aside as reward for veterans of the War of 1812. The first land ownership in the county was initially granted to these veterans about 1818, although many of them sold their land rights to others. Land granted to veterans of the War of 1812.  The newspaper the Bounty Land Register, first published in 1835, to advertise lands granted to veterans, is one of the ancestors of today's Quincy Herald-Wig newspaper. 

Thomas McDonough (Macdonough) and Alexander Macomb were both heroes of the War of 1812. A statue honoring McDonough and Macomb is located in Chandler Park, Macomb IL.

A descendant told me there is a Court Record on file in Vermillion Co
showing that our Joseph Osborn was arrested for assult, and further that
Ephraim Osbone, his Nephew, bailed him out.  This is for future study
listing here for the record, and so I don't forget... I would venture to 
guess this may have occurred prior to 1830.

County Formations - Osborn Family Movements
Good to read before reading the Census below:

When the Osborns moved into Virginia a from North Carolina ca 1766, the land was Augusta Co Va. formed 1738 from Orange Co., then in 1770-73 Botetourt Co Va., then the shortlived Fincastle Co Va in 1774-76, then Montgomery Co Va from then to ca 1794/6, Wythe Co Va a few years, then finally Grayson Co Va

The "War" years were in Montgomery Co VA, and as such Capt. Enoch Osborn was a Captain in the Montgomery Co VA Militia. The 1774 Capt. Herbert List has Enoch, and several of his brothers as Indian scouts, and when payments were made Enoch had a horse, and was paid more than the other Osborns, paid also was Daniel Boone, and his illfated son.

The Osborn's of Russell Co VA, Scott Co VA, and lower VA counties descend from nephews of Ephriam Osborn, Sr, sons of his brother Caleb Osborn of Rowan Co NC---Stephen, Thomas, and James Osborn. Thomas Osborn was shot in his doorway by Indians from the Detroit area ca 1790.

James Osborn, grandson of Ephriam Osborn, Sr through his son Solomon Osborn killed in 1764, was raised by his step-father Woods line, and is always associated with them around Castlewood VA. He is the one with the Solomon, Enoch, and Jonathan is common to both families. Caleb runs in the Ephriam Osborn, Sr line of Grayson Co VA. None of the Grayson Co VA Osborns left the "nest" until 1789 when Solomon married Mary Stewart is in Wilkes Co NC, where his son James Osborn was born in 1790.


The Two Pennington lines do not appear to be related: Micajah P. m. Rachel Jones has descendants living in Grayson Co Va area today, while Ephriam Pennington and his sons Timothy, and Richard P. married Hannah Boone Stewart lived around the Osborn's on north fork of New River in Wilkes Co NC until August 1797, when they moved to Ky-- maybe with Daniel Boone as they are together in 1798 near Lexington KY. 

You will notice that Ephriam and his son Richard Pennington were living next to Stephen Osborn, Jr in 1782 Osborn settlement (Montgomery Co VA).

I have tried to trace that Knox Co IL Stephen Osborn for some years. His sons ended up in Kansas. Had a Robert, or Caleb Osborn as a son, or Grandson. Stephen Oosborn was born in NC, and had a son born in VA ca ?1808. Riggs Pennington seems to have had a son Stephen Osborn Pennigton-- not sure when he was born, or whether he was named for Joanna Osborn's father?

If you check the 1782 personal property tax for Montgomery Co VA for Osborn's when Joseph Osborn was 1 year old, you can see Solomon Osborn m. Stewart was not a head of household (not married), and that the possible choices for Joseph Osborn's father is either Stephen Osborn Jr, or his brother Robert Osborn, Sr., brothers to Capt. Enoch Osborn, and my ancestor Jonathan Osborn.

1749 - Grayson Co VA   - Mention of Osborn's Station:

Andrew Baker Jr., born 1749 in Grayson Co, VA He was a Captain in the Revolutionary War Settled at Osborn's Station on New River, in what was Wilkes County, now Ashe County, NC It was here he probably met and married Elizabeth Avant. Several of their children were born while living at Osborne's Station. Andrew Baker laid claim to a tract of land he called "Peach Tree Bottom" in Grayson Co, VA in 1752.

1770 - 1778 - Abel Pennington sold land to
                                     Enoch Osborn 1779: (Wilkes Co NC)

Abel Pennington was in Wilkes County, North Carolina, in 1770 with Micajah, Benjamin and William (all of whom may have been brothers) and Benajah, perhaps the father of some or all of these men.  Benajah may have been the son of Ephraim.  In 1774 Abel had 150 acres on the New river.  In 1778, Abel was still in Wilkes Co. where he served on a road jury to lay out a road from Deep Fourd to Benajah Pennington's mill.  (Revolutionary War patriot for road duty.  Accepted D. A. R.)  In that same year Abel was an assessor in Captain Baker's District.  Also in 1778 a Wilkes County Grand Jury issued a warrant for the arrest of four couples for "living and cohabiting together without being lawfully married."  One of the couples was Abel Pennington and Sarah Sweeten. Abel posted bond to appear in court on the first Monday in December.   The case must have been settled, presumably by marriage, because Abel was a juror several times in 1779 and that same year sold land in that part of Wilkes Co., (which became Ashe County) to Enoch Osborn.

The Osborne Family:
     Esquire Enoch Osborne settled on NEW  RIVER, near Bridle Creek;
This for many years was known as the Osborne Settlement. Enoch
Osborne had three brothers, Solomon, Ephraim and Johnathan, who
came to this country with their families about the same time, and settled
on New River, near together. 

     A fort was  built on the farm now occupied by Joshua Osborne and 
son, John, at Ancella Post Office.

     Enoch's wife was Miss Hash.  Their home was a resting place for the
wayworn traveling preachers.  It was at the old Fort where Esquire Enoch 
Osborne, Sr., first located a home. 

     Brother Solomon was killed on a hunting trip by indians with Enoch
and Ephraim.  Solomon Osborne Jr., (not sure Jr to who?), married 
Hannah Cox, lived at the old Fort on New River, and on the same farm
his son Joshua now lives...

Chain Carrier for Solomon, in Wilkes Co., I have not seen 
this myself. 

What is a Chain Carrier?

The reference to Joseph being a Chain Carrier on the deed states that Joseph was on the survey crew that measured the amount of land that Solomon had or was buying or selling. Land was measured by Rods or Chains. A chain is 66 feet or 4 rods. An acre is 10 square chains. In the 1700 and 1800s some of the deeds listed all the members of the survey crew. I'm thinking this might have been a good way to have witnesses to the boundry lines if needed later. The Chain Carriers marked the corners and measured the number of chains between them. Also I am sure your Osbornes were the same families who lived in the Forks of the Yadkin in the mid 1700s. The Rowan Co Library has a map that list the Osbornes as land owners. The family of Daniel Boone was also there at that time. This area is in present day Davie Co NC South East of Mocksville NC and near Coolemee NC.        by: William Horton

who, this older (than Joseph), Wm Osborn was on the 1830 
McDonough Co IL, 1st ever, Grand Jury, in this county..."

RESPONSE:

"Stephen Osborn, Jr was likely the father of William Osborn who was the chain carrier for Robert Osborn JR in Wilkes Co NC --later Ashe Co NC-- in 1798. And Robert Osborn JR., and Solomon M. Stewart were likely his brothers.

COMMENTS:  

1800 KY Census:  All of Solomon's children are to YOUNG to be on the 1800.
1810 KY Census: Joseph, would now be old enough to be on this census, I believe there are
           MISSING CHILDREN in Solomon's family, if Joseph born 1781, and the
           next child 1790???  I suspect there were others between 1781 and 1790... 
           Of course others came later from NC, and some living with dad no doubt, etc.

Notes:

After the 1820, Moses Pennington died 1821, and as tradition held in those days
the children usually scattered to find affordable lands, if in fact Solomon died in
Vermilion Co IL 1828? I would have expected his litter to scatter at that point,
so by 1830, we find Joseph Osborn & Nancy in McDonough, and Ann Pennington
the mother of  Nancy Pennington.  Some of Joseph's children in Vermilion Co IL,
in 1830.  Sounds like a plan...

Notes on the 1810 census above. 
Joseph had 3 children in 1810, one born that year, could have been before 
the Census was taken.  2 boys under 10 yrs of age and one girl, same. 
The Joseph living next to Robert fits our Joseph like a glove.  The two oldest 
Gentlemen in the 1810 are Robert & Solomon, both are 45 years old and 
upwards, Solomon and/or Robert could be a very much older child, more 
likely they are brothers or other relation. Note 3 of  the Osburns living by 
Robt (sr) are within a 10 range of each other with the exception of the other 
Robert who is between 26 and under 45 yrs old.  Now the big question, is
this JOSEPH the SON of Robert?  or a SON of SOLOMON?

Notes:
The original Census shows ORSBERN, though I believe it to be Osborn. The problem
for me, is Joseph is showing 6 boys and 3 girls, could be some died before the 1830, is
possible some died before Joseph's Will, or just left off the Will, or, he has children or 
Orphans from other families living with him, maybe, children from his first marriage?? 

The Stephen and Riggs, appear to be the same pair showing in McDonough Co between,
1826 and 1828, and again appearing together in Knox Co IL, on the 1830 Census. 
I would be hopeful of other documentations in Franklin Co IL to support the 1820 census.

is Nancy, they are probably the group in Franklin Co IL, and ahead of
the main Osborn Group in Crawford Co IN.

(Basil Lewis case)
Ephriam Osborn surity for $50 also
He pleaded not quilty so went to trial.
2 juries couldn't agree on verdict, so trial continued to next year.

I think it was in Oct. that the bail was paid. 


1829 - New Salem Twp - Pennington Point McDonough Co IL

Derivd its name from the fact that
WILLIAM OSBORNE camped on its banks the entire summer of the year 1829. At the time the timber near the Creek was large, and the land farther out on either side was covered with hazel brush, crab apples, plum trees, etc. At the present time, none of this is to be found.

then on McDonough Records was in the county in 1829.  Son of his

Performs the first marriage in Salem's township between Mr. Morgan Jones and Miss Elizabeth Osborne, who were united by JOSEPH OSBORNE, Esq., February, 1834.  I believe this was at Pennington's point, home place of Richard & Delilah Pennington, relatives of Joseph Osborn's alleged 
wife Nancy Pennington Osborn.  

Joseph also married James Osborn & Ruth Smith (dau. of Joseph Smith).

Osborn is Joseph Osborn and his wife Nancy, possibly sister to Joel and daughter of Moses.  William, Joel, and Riley all named daughters Nancy.

**Make note here that Solomon, John, Ephraim are not listed, 
    my guess is Ephraim and John had moved to McDonough Co IL
    and Solomon also, at least to 1832, as a Solomon shows on the 
    enlistment at Macomb McDonough Co IL in Jun 1832, for the 
    Black Hawk War,  he served 86 days then was discharged, if 
    this were he, he may have moved to Franklin Co IL, after this 
    date.  Worthy to note 80 acres grants were given as compensation
    for service in this conflict. Currently, I haven't found John Osborn
    on the 1830/40 census, yet! Note there are two JOSPEH's in Vance
    township, not sure who they belong to, we know from the 1830 census
    that our Joseph was in McDonough Co IL.

Industry Township, NW1/4, Section 23, 
a half mile south southeast of Industry. 

Remarks: 
Present condition of this family cemetery is extremely poor. The fencing is gone. All stones that were located were broken and covered with grass and brush. A number of unreadable field stones were found in this cemetery. The Wilhelm graveyard lies about 100 yards to the east of this site.

Joseph Osborn [Osborne] Born: 1788 in North Carolina [per 1850 McDonough Co., IL Census (1860 & 1870 Census lists VA)]. Mr Mayfield orginially gave 1781 when he saw the tombstone in 1993. The Peak Cemetery is an unused and unkept cemetery with broken, fallen and weathered stones. It was diffucult to read with what equipment Mr Mayfield had with him at the time.

Note Joseph is 89 Years old - Died: Nov 12, 1870
As the Cemetery is in very poor condition and most
of the Stones destroyed, we can only assume Nancy
is buried here also, as the family was still in same co. aft 1870
The Grave stone was witnessed in 1993 by a Mr Mayfield and had
no equipment with him in 1993, to highlight the stones correct date...

McDonough County IL 
(25 Jan 1826)

McDonough died 10 Nov 1825 while in command of the Mediterranean Squadron. McDonough County, Illinois was created less than two months later (25 Jan 1826). Macomb was named commanding general of the US Army in 1828 and remained in this position until his death in Washington, DC in 1841.

Thomas McDonough (Macdonough) and Alexander Macomb were both heroes of the War of 1812. A statue honoring McDonough and Macomb is located in Chandler Park, Macomb IL.

Thomas McDonough was born in 1783 in Delaware. At age 17, he joined the US Navy. Alexander Macomb was born in Detroit in 1782, but spent most of his childhood in New York. At age 17, he joined a militia in New York City. Macomb continued his military career and was one of the first two students to complete formal training at West Point.

During the War of 1812, McDonough was a Commodore of the US Navy, while Macomb was appointed Adjutant General of the US Army. McDonough commanded the fleet of 14 vessels on Lake Champlain in their defeat of the British near Plattsburg, NY on 11 Sept 1814. Macomb and his force of less than 8000 faced nearly 11000 British troops at Plattsburg, NY. Macomb's troops were also victorious over the British at Plattsburg on 11 Sept 1814.

Prior to the land and naval battles of Lake Champlain (Plattsburg Bay), it appeared that the British were winning the war. McDonough's and Macomb's victories forced the retreat of the British from northeastern New York state into Canada. The British failure in the campaign along Lake Champlain led to the end of the War of 1812.

McDonough died 10 Nov 1825 while in command of the Mediterranean Squadron. McDonough County, Illinois was created less than two months later (25 Jan 1826). Macomb was named commanding general of the US Army in 1828 and remained in this position until his death in Washington, DC in 1841.

Black Hawk War (1832)

Schuyler Co IL - Rushville Recruitment 

Among the number, who then resided in the territory, now comprising Brown county, but then a portion of Schuyler county, that responded to the first call for troops made by Gov. Reynolds, May 26th, 1831, were: R. N. Curry, S. P. O'Neal, Green McHatton, Daniel Kendrick, Matthew Alexander and John Six, who enlisted in a company at Rushville commanded by Captain Hart Fellows. Also Philip S. Howes, John Ausmus, Henry Ausmus, Samuel Hollingsworth and Philip Ausmus, who joined a company raised by Captain Vance of the same town.

Hostilities being again resumed in 1832, the Governor issued another call for the troops to assemble at Beardstown, on the 22d of April of that year. The quota of men required from Schuyler county was one hundred and fifty, the county then being under the militia law of state. The 23d day of April, 1832, was appointed as the day of mustering the required number at Rushville

In a short time after the enlistment of the men comprising the company whose history we have just briefly recited, another company was organized at Rushville, and attached to the Old Battalion of Mounted Rangers, called into the service of the United States on the requisition of General Atkinson, by the Governor's proclamation, dated May 30th, 1832. The roster of the company was as follows:

Officers.--John Stennett, Captain; Daniel Mahoney, first lieutenant; Joel Pennington, second lieutenant; John R. Smith, first sergeant; Samuel L. Dark, Morris Hobart, Philip Horney, sergeants; Robert Martin, Eli Williams, James Beel, and Josiah Price, corporals.

Notes from Mike White: 
Joseph Osborn lived in Industry on the McDonough Co side
of the border with Schuyler County IL, Riggs Pennington was
the Uncle of Joseph's wife, Nancy.  So, there is a probability
that  this Joseph Osborn listed is our ancestor. Though he 
was upwards of 50 plus years old, I still believe this could be
our Joseph, worthy to note, Riggs Pennington was of Joseph's
Generation and wasn't a spring-chicken himself... If I might add.
In 1832 Riggs was living in Knox Co IL, just north of Schuylar,
but had lived in Schuylar prior to moving to Knox. 


1832 - MCDONOUGH COUNTY HAD A RECRUITMENT
                at Macomb for the Black Hawk War - June 1832.  

June 1832 a battalion of men was raised in this and Warren Counties, under call of the Governor, for service in the Black Hawk War. The organization was effected at Macomb, the Warren County men coming to this palce for that purpose.

The group selected were out eight-six days, bur performed no special service. They drew their rations regularly, ate heartily, played euchre, and visited the friendly Indian camps ont he opposite side of the river. At the expiration of their term, they all returned to Macomb , and received their discharge.

The following were among the number serving in this war:
Major Samuel Bogart, Lt John Wilson, David Clarke, James M Campbell,
LARKIN OSBORN, JEFFERSON PENNINGTON, 
SOLOMON OSBORN.


This Battalion was mounted, each man furnishing his own horse, and, as remarked, were oiut eighty-six days, and received eighty-six cents per day for self and horse. Afterward he general government was kind enough to give to each participant a bounty of eighty acres of land.

What was the Black Hawk War about?

In May of 1832 Sac and Fox Indians under the leadership of Black Hawk left the Iowa territory and returned to their homes across the Mississippi River in northern Illinois. These Native Americans had lost their Illinois lands in a disputed treaty signed in St. Louis in 1805. Their return to northern Illinois sparked widespread panic among white settlers, and Illinois Governor Reynolds quickly called up the militia, which included a young Abraham Lincoln.

Both the militia and regular army troops proved unable to locate the elusive Indians at first, but by July they had begun to pursue Black Hawk's band across northern Illinois and southwestern Wisconsin, engaging them in a major conflict at Wisconsin Heights before finally routing the Indians at Bad Axe on the Mississippi River.

Leader of this mixed band was Black Hawk, a sixty-five-year-old Sauk warrior. Black Hawk had led Sauk, Fox, and other native warriors against his people's enemies, including Americans, for nearly fifty years. In April 1832, however, Black Hawk sought not honor, horses, captives, and scalps, but freedom and peace on the lands of the Winnebago prophet. He was prepared to fight, but whether he would have to or not would be decided by whites. Black Hawk's dreams of a peaceful retirement were quickly shattered, however. His band's presence in Illinois quickly spurred fear and then hysteria among white settlers. The U.S. Army, the Illinois militia, and groups of Sioux and Menominee warriors started to pursue Black Hawk's band within just a couple of weeks of the crossing of the Mississippi.
