The State of
Texas
County of Bowie
Know all men by these
Presents:
That
I, Ilie
White, of Bowie
County, Texas, being of
sound and disposing mind, memory and understanding, do hereby make
and publish this my last Will and Testament, hereby revoking all
former wills, if any, by me heretofore made.
1.
It is my will and I do hereby direct that all of my just
debts, including those of my last illness and funeral expenses, be
paid by the executrix of my estate as soon after my death as it may
be practicable under the circumstances.
2.
I hereby appoint my niece, Emme
Lee Phillips,
Independent
Executrix of my estate and direct that no bond shall be required of
her and that no action be had in the County Court in relation to
the
settlement of my said estate other than the probating and
recording
of this my Will and the return of the statutory inventory, appraise-
ment and list of claims and of all claims due of owing by me at the
time of my death, and I hereby authorize and empower my said
Exeutrix
to sell, dispose of, deliver and convey any of all of my said
estate,
whether real of personal, at public or private sale, for any price,
on any terms and in any manner that she may deem best for the
purpose of liquidating and distributing my said estate as
herein
provided for, and I direct my said Executrix to as soon as
practicable after my death to liquidate my said estate and
distribute
the proceeds thereof in accordance with this will, such Executrix
to receive from my estate, in addition to her portion thereof
as
hereinafter provided for, the fees and allowances provided for by
this laws of the State of Texas.
3.
It is my will and I hereby will, devise and bequeath all
of my estate, real, personal or mixed, in equal portions, share
and
share alike, to the following nieces and nephews who may be living
at the time of my death, to-wit: Charlie
Holley; Chester Holley;
Clifton Holley; Sedra Bowman; Velma Holley; Lona Holley; Orba
Maxwell; Vanoy Holley; Truman Holley; Wilbur Holley; Maye Brown;
Lena Carter; Louie Holley; Frank Holley; Joe Holley; Doyle Holley;
Raymond Holley; Ross Holley; Berline Holley; Helen Marsall; Emma
Lee Phillips; Mattie Carrie Robertson; Willie Nell Paul; Lucile
McClurg; Luna Johnson; Odell Fowler; Clemmon Fowler; Junior Fowler;
Elma Foster; Merle Gipson; Purney Booth; and Patsey Hooker,
it being
my intention that should any one or more of my said nieces or
nephews predecease me that the share of my estate intended for
such
deceased niece or nephew shall not pass to their heirs but will be
equally divided among my nieces and nephews who may survive me.
4.
It is my will and desire that my said Independent
Executrix, Emma Lee Phillips, shall have complete and absolute
authority over all of my estate and affairs without any interference
or hinderance on the part of any of my heirs and that she shall
immediately of as soon as practicable after my death process to
liquidate my entire estate and thereafter divide the net
proceeds
therefrom in accordance with this
will.

Emma Lee Phillips, Independent Executrix of the Estate of
Ilie White, Deceased having collected the estate within the time
required by law, make and represents and shows to the Court that
this is a full, complete, true and correct inventory and
appraisement of all of the property, both real and personal, of
such estate which has come to her knowledge and that the
appraised value of each item of such property is stated opposite
such itme in the inventory, Viz:

situated in Bowie County, Texas, particularly
described as follows: A part of the John
Downey Headright Survey situated about 2-1/2
miles NW of Maud and
described as BRGINNING
at the NE corner of a 100 acre tract deeded
to C. W. Whittington by J.
C. Harris;
THENCE
South 297 vrs to stake for corner, a new
corner; THENCE West 474 vrs a new line to a
stake for corner; THENCE East 474 vrs to the
place of beginning, containing 25 acres of
land, AND BEING the same land conveyed to
Arthur Ritchie and wife, Hazel Ritchie, by T.
Melvin Fowler and wife, Annie Fowler,
by deed
dated May 19, 1943, recorded in Volume 187,
Pag 588, of the Deed Records of Bowie
County, Texas, to which reference is here
