The Spivey-White Cemetery is in the Kittrell Community which is on Highway 230 in far north Walker County. It is west of Trinity, Texas. Kittrell was once part of Trinity County before being taken into Walker County. It is also just across the Trinity River from Houston County and is also across the Trinity River from Madison County. You need to check Trinity, Houston and Madison Counties.

Fereby A Spivey's grave was reconstructed from pieces and photographed it was originally listed as Frances
A Spivey, next to JLS's foot stone, we believe this could be her husband John L Spivey, instead of their
son JLS or Joseph L Spivey, however, he may also be buried here, as there are still unknown graves.

H"...Last weekend my husband and I found the Cemetery. The first gate was open so I walked to the site and then came to a  5'locked chain link fence. When my cousin does become available with the key, we plan to do some clean up.  Tilman and Sarah Francis's graves are in poor repair. There was a Steven but this is their son. The grass was high, so there may have been someone I missed. We will be going back...."

On this Feb 24, 1868 

Came on to be hand application of Tillman B White for
Letters of Administration on the Estate of his Father
Stephen White and it appearing to the satisfaction of
the Court that Decedent was a Resident of the 
County and departed this life intestate so far as known
and that he legal notices have been given and did
Tillman B White being a Suitable and proper person
to administer of said Estate -- the Court here 
appoints him as Administrator upon his entering into 
Bond in the sum of Eight hundred Dollars
payable and conditional as the lien directs and 
taking the oath prescribed. 

As appraising of said Estate who with the said White 
as Adm. will send us a true Inventory and 
Appraisement of said Estate within the time prescribded
by law.

ABOUT STEPHEN WHITE'S FAMILY:

Note:
The Children of Stephen & Nancy were recently discovered, on a posting on Ancestry.com

     The posting brings everything, I already had & suspected together, the mysterious; Sion Pritchard
in Houston Co TX with Stephen and the 'Levi W White', living next door to Stephen and Nancy in the
1860 census, which turns out, is in fact his son, and Sion Pritchard the husband of Milly White, daughter
of Stephen & Nancy.  The Pritchard Children living with Stephen & Nancy in 1850, are his grand children,
Milly & Sion are deceased by 1850.  It also sheds light on the Pritchard's living with Levi W. White in 1860,
family caring for family.  

     The Ancestry posting has many errors, but is generally correct, and verifiable to a great
extent. I have been informed that the originator on this information is now deceased, before
his death, he gave all of his reserach to a cousin, who had it posted with LDS.

     We now know that Robert White Sr's grandson, Isaac P. Murphy, mis-takeningly used
BEDDINGTON for Nancy's surname, instead of Betterton, but this name is among the 
most commonly misspelled surnames.

Will be pursuing the new information in the coming weeks/months, and updating the
site as the information is found...

Notes:
It appears the Thickety Creek area of Spartanburg SC, 
is the place, Stephen lived after leaving Union Co SC.
Apparently, Thomas Betterton, sold his son-in-law some
acreage.  I do not see Stephen White or Thomas Betterton
on the deed index's after 1813.  This may be the time frame
they departed SC for GA.  At least by 1840 Thomas was 
living in Fayette Co GA. Stephen of course may his way to
Alabama by 1830 and onto Texas by Jan 1836. 

The marriage date I've seen floating for Stephen of 1807 
to Nancy Betterton, daughter of Thomas, seems a bit more
resonable since learning of Stephens deed transactions. 

I might add Stephen's mother Mildred Whitehead White 
died in 1807.  

Notes:
Recently (Nov 2007), Kathleen Mays discovered that Stephen
White lived in Putman Co GA and Morgan Co GA., these were
area's involved in the Land Lotteriers later.  There is a Stephen
White living near names he once lived with in SC. Including
his father-in-law Thomas Betterton and a person he sold land
to in SC, Warner Sherbert (spelled many ways).

Tilman, John and Athenah 
are listed on a deed as selling land for $350 to David Nunn. This
is witnessed by John F. Auld and Robert Perry, both Justices of 
the Peace. All the Whites have their mark, implying they were illiterate.

Stephen and Nancy 
were paid $800 by Tilman for land sale witnessed by Varner and John Bonnell. 

Jan 17 1834 (Lowndes Co AL)

bought land for $125 from Reason Franklin in Hayneville. It was bordered by land
belonging to Susanah Esenhaus? Senior, George Gi****. This was witnessed by
Robert Perry, Stephen White, and WILLIAM LUCKIE.

 What inspired Stephen to move to Texas from Alabama?

Oct 5, 1835, Isaac Parker of Mustang Praire (later Houston Co TX), under the direction of Gen Sam Houston, road through the
South, to rally support from settlers that Texas was about to go to war with Mexico, to gain independence from said Mexico, he gave
them promises, that Land Grants and Bounty Grants would to allocated to those who enlist into the republics Army of Texas.  Many
settlers migrated to Texas to fight in the War of Independence from Mexico.

January 1st, 1836, Stephen White and others from Alabama arrived at Mustang Prairie Texas, and enlisted into Capt. Elisha Clapp's
Texas Rangers, under command by Gen. Sam Houston. 

Sept 10, 1836, Stephen, his son Levi enlist into service.  In addition to fighting the Mexicans, they also, fought the Indians.

July 1st, 1836: Stephen's son-in-law, Sion Pritchard, enlisted in Austin Texas under command of Horatio N Cleveland's company. They
later fought at San Jacinto, but Sion's service may have expired before San Jacinto, as he is not listed on the roster of soldiers who
fought, at that final battle.

...In 1837 the boundaries of Houston County were laid out and its government was organized. It was named for President Sam Houston, who signed the order establishing the county on June 12, 1837. Upon its formation from Nacogdoches County in 1837, Houston County included the territory that later became Trinity and Anderson counties and part of Henderson County. Land was donated for the county seat by Andrew E. Gossett, who named it for his father's friend and former Tennessee neighbor, David Crockett. Collin Aldrich was first chief justice; George Aldrich, county surveyor; James Madden, Sheriff; and Stephen White, clerk of the district court...

    Land Map

    Stephen White may have had lands in this same area at one time?
    His lands were in Kaufman and Anderson Co TX, and also had a grant
    in Houston Co TX. An old map of Anderson might show Stephen's 320 acres there...

    Levi W White Houston County Lands on 1859 Map

    found 3 plots of land for Levi, 2 east of Crockett, and one south toward bottom.
    found 2 plots of land for Wm White (possible brother of Levi).
    found 1 plots for the L Pritchard, remember the L & F in those days looked like a S= for Sion.

         In 1860, Stephen appears on Poll Tax for Pritchard Children that his wife Nancy was
    guardian for, and paid their Poll Tax. I believe that land is in the upper right section of
    this map, says L Pritchard, but should be S Pritchard, for Sion their father.
    Levi's father is not on this map, in 1865 Houston Co TX Poll Tax, his father shows as
    having 2302 acres of land next to his name is Kaufman Co TX, Stephen used his
    headright and surveyed 4605.50 acres in Kaufman Co TX, but appears to have sold part.
    This was land granted to him for his emigration to Texas in Jan 1836, and he pays the taxes
    from Houston Co TX, he sold his Bounty Land (320acres) in Anderson Co, formed from
    Houston Co, in 1845 & 48. Was granted 318.50 acres in Houston Co TX, in 1858, this land
    he lived on and cultivated.  Stephen is on the Kaufman Co Map, I do not know if he actually,
    ever lived on that land, but paid taxes on it from Houston Co, I suspect he sold that land
    in Kaufman piecemeal, for income in his later years, but he is the original grantee of that land.
    In Total Stephen once owned 5244 acres of land, in three counties.

    By 1860, Stephen was in his 70's, I don't think he was farming, at this age, but sold or had
    his children work the land. He operated a Ferry boat, on the Trinity, for a time, and owned
    a Mill, for two years, and sold lands, as was needed, for him and Nancy, in their later years.
    His last poll tax in Houston co stated; "Estate of Stephen White (return of unrendered
    property real and personal), 160 acres, value 300, .45 state tax, Co tax .45. His probably died 1868.

    Son John S White, sold his lands in Panola and moved to Kaufman by 1870, I suspect to take
    over his father's land in that county, a local look at Deed transactions might prove this theory.

**It was 'very' common for the Census takers to make mistakes, 
    Stephen & Nancy's age is off, Nancy was older that Stephen,
    it was also common for women to give younger ages as they 
    do even today... the child between 10 & 16 couldn't be theirs,
    might be a relative or a child they are caring for...

Note2: 
I am sure that this is our Stephen White, on a 1809 
Deed his father-in-law sells him land, on the deed are
John Lipscomb and Warren Sherbert (Shurbutt) who 
are neighbors on the 1810 Census of Stephen White.
The deed is in the Thickety Crk area and this is where
the Lipscomb families were located. On yet another 
deed in the same area Thomas to Stephen, his property
borders a Dunaway, the 1810 has a James Dunaway 
living a couple of doors from Stephen White.

Mr Stephen White Guardian
Thereas at the December term of this court 1848 on order was named
upon the application of said White for Letters of guardianship on the
person and estate of said minors that be be appointed guardian on 
condition that he eter into bond within the terms prescribed by law. 
Which the said Stephen White failed to ????? is therefore ordered 
that an order made in relation thereto at said December Term 
last past be and the same is hereby revoked and that said 
White pay the cost in said proceedings and that execution issue
for the same.

Mildred White Pritchard the wife of Sion died about 1848
this was also the last year I find Sion Pritchard on Houston
County's Tax List, Stephen was Estate Admin. by 1852, so
I place Sion's death between 1848 & 1850.  Stephen and 
wife Nancy were the Guardians of the Pritchard Children 
until they came of age, however, in the 1860 Census 2 of 
the Pritchard Children are living with Stephen's son Levi 
W White, who was living next door to his parents, now in
their mid seventies.

Notes:
What do we learn from the Tax Records:

Stephen was the Estate Administrator of Sion Pritchard his son-in-law, and he 
  and Nancy are Sion & Milly's children's guardians. 
Stephen & Nancy are in Walker Co in 1850 by 1852 Stephen & Nancy are back in Hou Co.
  1852 is the first I find Stephen & Nancy as Admin. of Sion Pritchards Estate on Tax rcds.
Stephen may have died between 1865 and 1868 no longer on Tax records, Houston Co.
Nancy White died 1865 or there after... is no longer on the Tax records with Stephen
Tilman B White moved to Walker Co TX after 1848, he is on the 1850 census
  in Houston Co, but not seen on the Tax rolls after 1848, is on 1860/70 Walker Co. 
Levi W White, son of Stephen, appears to have lived consistantly in Houston Co TX,  
  at least between 1839 and 1865, though Levi appears a couple on time at 1865 on the
  Houston Co Tax Records, it is as 'Unrendered Property, and so does his father, it is 
  my opinion that both Levi and his father are either deceased or living elsewhere. 
1839 Tax Roll is significant as it shows Stephen and sons; Levi, Tilman, William and 
  son-in-law Sion Pritchard and no doubt Milly White his wife was still living. 
The other Children; at this time I cannot for sure account for John Stephen, Stephen 
  Murphy, Lavina Bailey Harwell, Wm W, or Nancy Matilda White.  though there were
  Wm's and John's etc, in Houston Co, I cannot say they were ours, at this time, I would
  be surprised if all had survived to adulthood.

"Did you know that the Big Hill across the road from Mt. Lebanon Baptist Church, just across the
county line in Union, has always been called Betterton Mountain. Some of the older people around
there said they heard it called "Betton Mountain". It is the highest point between the Union Court House
and the N.C. mountains, or so they say. It was listed on a deed of James Betterton as "the hill".

Note from Mike:

The Census above tells us the Nancy Betterton White's family
left SC sometime after 1810 and prior to 1820, Thomas is not
found on the 1820 in Spartanburg.  Since Fayette Co GA formed
in 1821, we would not expect to see him on a census in GA before
1830, will have to find some other record to verify their move to GA...
It is my belief that Stephen may have left with the Betterton's to GA. 
Many areas of Alabama were still not safe for settlers in 1820, as the
Indians still had control of much of the land.  If we can find a time
line when the different counties were declared safe in AL, we may be
able to predict Stephen & Nancy's arrival in AL or departure from GA
 most likely it was MontgomeryCo AL, as Lowndes was carved out of 
Montgomery, in 1830.

The is basically no information on the Beddington family of 
Union or Spartarburg.  The only information I have thus found
are two deed index's one in Union and one in Spartanburg.

      I’ve read through the great information and a couple of names jumped out.  Deed Book F p. 431 has Samuel Fielder buying land on Hard Labor waters.  It is witnessed by Stephen White and the J.P., Levi Renalds.  He is also the J.P. on Deed book G, p.90 (again Stephen witness) written as Levi Reynolds.  He is Levi Runnels (later changed to Reynolds) of the Runnels clan that I am familiar with.  His parents are Dudley and Fannie Herbert Runnels, formerly of Caswell NC.  There is another Dudley Runnels of Caswell that is either his father or his uncle, no one is quite sure.  On the White side he stands out because if you look on Mike’s website you will find Dudley Runnels mentioned in a land transaction of Robert White of Caswell.  That’s a heck of a coincidence and seems to support Mike’s theory that this is our Robert.  You will find Samuel Fielder listed on p.122 on the 1817 Morgan tax list along with Stephen.
 

The Fielders and Runnels are part of a large group that migrated together.  I read about them at this website http://www.eaglequestpro.com/ray/FindingAncestors.htm

 

     Levi Runnels aka William Levi Runnels aka Levi Reynolds, was born in 1785, about the time his parents moved to Wilkes co GA.  He wound up in Morgan Ga where his first child was born in 1814.  He was in the Claiborne LA 1840 census and had a daughter who married in Union co Arkansas in 1844.  (Union co Arkansas being of interest that some of Vincent White’s family was there about that time.)  He died in Claiborne in 1851.

thought it interesting enough to post it here:

Runnels

...Houston then set his sights on the governorship, and declared himself a candidate. In 1857 he was stunned in defeat by Harden R. Runnels. The Runnels family was thriving. The Harden name was also from the Dan River, with industrialists, bankers, and connections still from the mill people of England even today. Two years later Sam Houston won in a landslide. Shortly, the Civil War erupted, and in 1861 Houston is deposed when he refused to swear allegiance to the Confederate States. Houston's first son, Sam Houston, Jr., was badly wounded at the Battle of Shiloh, and Sam Houston (the "Raven") died the next year (1863). Temple Lea Houston, the youngest son of Sam Houston, continued the saga. The Runnels family of Caswell County, North Carolina is only one of many families to migrate south and west. Historian, Jon Kukla, author of "A Wilderness So Immense," told the story very well, and included names. He said, that he discovered that all the people who established the country from Jamestowne to Texas were all kin!! Yes, and many of them came through the Dan River area of Caswell County, and dotted the landscape with Baptist churches....

     If you look at the website listed above, it was the Harwell side that had me looking over it initially.  My only leads on John Harwell who bought land in Lowndes AL are:
 

     John Harvill married Betsey Davisson 20 Dec 1801 Oglethorpe GA.  She fits the bill that she was born in GA (per James on 1880 census), and died before her parents (pre1830).  The only family she fits is Joseph and Sarah Peavy Davidson of Oglethorpe, who went to Montgomery Al before it was a state and returned back to GA.  If you look closely on the Warren GA 1794 tax list on this website you can see that the Peavys and Davidsons were living with the group of Fielders and Runnels in Warren, and moved, like them, to the Oglethorpe/Clarke co border area.  John Harwell is on the 1805 land lottery in Clarke GA.  The other Dudley Runnels died in Clarke in 1805.  The Peavys and Davidsons are still living in Oglethorpe, along with the Luckies (Stephen’s dau married a Luckie, ancestry unknown)  In March 6 1817 a John Harvill married Lavinia Runnels in Warren GA.  Same guy, second wife?  As you can see from the website, the groups migration took them to Morgan GA and then off to Mississippi.  It seems that there are always Runnels close by, even though it is not a common name.  If you Harwellians look at the website maybe something will stand out for you, but all I have is that they are around a lot.

 

     The other name of note is Eleazer Jeter (wife – Anna Moseley) who is the JP on Deed book F p.460 in a land transaction of Stephen White.  Eleazer was b. 1775 in Lunenberg VA, moved to Union SC as a small boy, was in the Horn’s Creek area of Edgefield SC by 11 Jan 1796 where he was on the 1800 census and left ca. 1805. He is in Morgan GA by 1815 where he sold land on Hard Labor Creek in 1817.  He is a justice in Montgomery AL 1818-1820 and dies around 1820-21.  A number of his children and Moseley cousins move to TX and live by John S. White in Panola co. TX.  I mention him in that he substantiates that this is truly our Stephen White in Morgan GA. Where and when the Jeters and Whites got to know each other is unknown, but they migrated to the same places in 4 states for at least 2 generations.  The Jeters and Moseleys were Primitive Baptists and founded the church in Pintlala, Montgomery co AL, just over the border from Lowndes.  I have read through the church notes and the only Whites were Benjamin and Rachel.  They lived in Lowndes  close to the land of John Harwell.  They originated the church with the Jeters and Moseleys.  Benjamin got thrown out for a while but was received back in a couple of years later.  They are not the same Benjamin and Rachel White whose children had adjoining land with John S. in Panola co TX (Unfortunately!)

 

     Person of Note:  David White moved from Morgan GA to Mont/Lowndes AL about the same time.  His daughter Asenath married Robert Ware who appears to be the nephew of the Wares in the land deeds.  If you see something on him it might be worth giving a peek.

 

     There is nothing to indicate either Benjamin or David are related to each other or our Whites.  They just live by them and associate with some of the same people so their names keep coming up.

 

      The land transaction of 1 Mar 1819 extends our time of when Stephen lived in Morgan, since before this it was the 1818 tax list.  It’s the next entry that’s interesting.  Looks like Stephen got in a legal disagreement, lost, and had his land put up for auction.  How did he wrong the plaintiffs?  John Whitaker is a common name, but William and Lancelot Johnston appear to be the sons of Dr. Lancelot Johnston of Caswell, NC.  (That county just loves to pop up) See http://www.southerncampaign.org/pen/w5114.pdf. Is this the motivation that moved him from Morgan to who knows where until 1830 Lowndes AL.

 

Bettertons:  We can now see ties with John and Levi Betterton in these land documents.  I don’t know much about them but would be very interested if anyone else could fill me in.

          fight in the coming Texas war for independence, with the promise of
          Land Grants and Bounty Grants for service in the war against
          Mexico. Then returns to Mustang Praire Texas, his home, later
          to become Houston Co TX
, where Stephen arrives in Jan 1836.
          Is this what inspired Stephen and his neighbors in Alabama to
          Migrate to Texas?  Wm Pate also arrived in Mustang Praire
          in Jan 1836, and was a neighbor to our Stephen White. Both
          enlisted under Capt Elisha Clapps Houston Co Rangers, under
          the authority of Sam Houston. Son Levi and son-in-law
          Sion Pritchard enlist
into the fight against Mexico.

0000 - This is where I left off... will add additional information over time...
 
Notes:
This family was involved in the Texas War of Independence, it 
also appears, several of the grand children of Stephen & Nancy served
in the Civil War.  

It appears from Probate records of Walker Co that Stephen and possibly Nancy died in Walker County Texas, Stephen by 1868, Nancy prior. Something happened to son Levi, who lived next door in 1860, his last tax record is 1865, his parents are elderly, and from evidence in Walker Co, they may have moved near Tilman B White, as he is the administrator on Stephen's Estate filing, in 1868.

The fates or whereabouts of Stephen M, William W, and Nancy M, is still unknown.
It is possibly they were deceased before the family left Lowndes County Alabama.
There was a Wm W living in Houston Co, I have not determined this to be Stephens,
Wm at this time. There may have been other Children, not known to me, Stephen M
enlisted with Levi White, however, this was probably, Stephen Sr and not his son,
in the War of Independence of Texas, a more thourgh investigation may reveal his location.
Nancy M, is a complete mystery...  However, she appears on a couple of online genealogies,
which I have not confirmed.

I suspect there was a bible record of sorts available to one of the Betterton researchers, as the children are named by first/middle/last names, unfortunately, this source of the middle names is deceased. Since I began my reserach I have confimed some of his informaion and thus far it is correct.  The 1830 census reveals that several of Stephen's children
had probably died before the journey to Texas.

Murchison vs T. B. White Sr

Case involves Estate/Probate of Stephen White

Case started in 1868 and opinion of court delivered Oct 19, 1880

In 1880 - T B White Sr was deceased, so case results handled by Heirs

Summary:
It appears to me that Mr Murchison was attempting to take over as the
administrator of Stephen's estate, possibly to resolve a debt, see explanation to right >>

Below is an Interpretation or the Supreme Court Case
made simple, for us who do not understand Law:

"The court opinion appears to tell us this:
 
     A probate was started for the Estate of White in Anderson County. The equivalent of an executor was appointed to deal with the affairs of the Estate. His actions were supervised by the court, so each thing he did was upon order of the court. The court ordered a mortgage in favor of Murchison against the Estate of White. There was probably some debt there in favor of Murchison against White.
 
     The court ordered the executor to sell land owned by the Estate of White - 2303 acres - in Kaufman County, and deed that land to Murchison; presumably to pay off the aforementioned mortgage. This was done.
 
     The White heirs apparently objected to this transaction later, and they sued to get the whole transaction overturned. They claimed: first, the original probate court did not have jurisdiction; and second, that Murchison had committed fraud in getting the deal.
 
     The Supreme Court ruled that the Anderson County court did have jurisdiction and that it was too late to claim fraud. The heirs had to make their claims within 2 years.
 
So, the sale of property with proceeds to Murchison stood. The White heirs lost their case."   (written by: Beth Jensen)

records his passage from San Augustine Co TX &
through Houston County Texas - now remember
that Walker County was formed in 1846, so at the
time of this writing, it was still Houston County TX.

(Thomas Asbury Morris 1794-1874 - American Bishop of the
Methodist Episcopal Church, elected in 1836. was a Methodist
Circuit rider, Pastor, Presiding Elder, from Ohio. Had been in TX
from Dec 17, 1841 to Feb 11, 1842, held a conference in San Aug-
istine Co TX, travelled from there, through Houston Co TX, to Austin)
This 2 page document transcribed, are of a Methodist Bishop
Travelling through Houston/Walker Co TX, in his
journal, of his travels, he describes a portion of his
journey, 'stopping by Sephen White's homestead',
in what became, in 1846, Walker County Texas.
This would have been Stephen's Property within
the Jose Ortega Survey, son Tilman B White was
also adjacent to Stephen's land, in this Survey and
son in law, Sion Pritchard, all were near the Wright's
Creek, tributary of the Trinity River. I have not found
this land record, in the GLO database, may been land
Stephen purchased via a deed/private transaction?
These pages confirms Stephen was a Ferryman,
and the owner of a Grist Mill (Lumber Mill) and
in 1842 was living in Houston Co, his land, soon to
become part of Walker County TX, in 1846
